Ruth Grant takes on the role of London representative, Craig Hoover has been re-elected to one of the “at large” seats, and Cate Stetson has been elected as the representative for the Washington, D.C. area.

Grant replaces Emily Reid, who has stepped down. Hoover, a Litigation partner in the Washington, D.C. office, will rejoin Daniel González and Michael Silver as the other at large representatives. Stetson takes over the Washington, D.C. area post from Helen Trilling. All begin or continue their roles as of 1 May 2015.

The Hogan Lovells Board comprises 12 members in total and has supervisory responsibility for overseeing the affairs of the firm, but without executive responsibility for strategy, management, and operating decisions. It provides input to the CEO and Hogan Lovells’ International Management Committee. Membership of the Board is designed to reflect the broad scope of the business, with members representing a combination of geographic and other backgrounds.

Biographical details on the new Board members:

Ruth Grant is a Litigation partner specializing in dispute resolution work, particularly in the fields of product liability and professional negligence. She has a broad litigation background based on more than 30 years’ experience handling disputes for a variety of commercial clients in the High Court in London and working with U.S. lawyers in proceedings in the United States for UK clients. Ruth is a former London Managing Partner (2005-2009) and firm People Development Partner (2009-2015). She is co-chair of Hogan Lovells Global Diversity Committee and chair of the London Committee. Ruth is also a member of the Solicitors Regulation Authority Equality, Diversity, and Inclusion Committee and the City of London Law Society Training Committee.

Cate Stetson is co-head of the firm’s U.S. Supreme Court and Appellate practice group. She has more than 50 arguments to her name, including in the Supreme Court, nearly all federal courts of appeals, and multiple state appellate courts. Her experience spans appeals presenting questions of administrative law and procedure, antitrust law, the Americans with Disabilities Act, the Employee Retirement Income Security Act, the False Claims Act, class certification, civil procedure, and constitutional, contract, copyright, employment, energy, environmental, food and drug, health care, insurance, patent, telecommunications, and tort law. Before joining Hogan Lovells, Stetson served as a judicial clerk to The Honorable Stanley S. Harris of the U.S. District Court for the District of Columbia and The Honorable David S. Tatel of the U.S. Court of Appeals for the D.C. Circuit.

Coats Rose Advises City of El Paso on Housing Redevelopment

The Coats Rose Affordable Housing Group served as counsel to the Housing Authority of the City of El Paso for the closing on the redevelopment of 13 properties totaling 1,590 units which were converted from public housing to project based Section 8 under HUD’s Rental Assistance Demonstration Program, the firm reports in a release.

The project was closed as one 4 percent tax credit/bond transaction with $125,000,000 of tax exempt bonds and $80,000,000 of tax credit equity.

The release says this represents the largest single issuance of housing tax credits ever approved by the Texas Department Housing and Community Affairs and the largest RAD conversion closing to date in the country. The total development cost was approximately $250,000,000.

Coats Rose attorneys Barry Palmer and Bill Walter have been at the forefront of the RAD program, having closed the first three RAD transactions in the State of Texas in 2014 and now following up with these 13 properties.

When HUD made this program available as a demonstration program in 2013 we recognized immediately that this is the future of public housing. This allows the Housing Authority to do renovations of over $65,000 a unit on these 13 properties. Dykema to Combine with Texas-Based Cox Smith

Dykema, a leading national law firm, will combine with Texas-based Cox Smith.

On its website, Dykema said the combination will give the firm a significantly expanded presence in Texas, where Cox Smith is a leading firm with deep history.

“The additional depth in key practices, coupled with the combined firm’s broader geographic reach, will enhance the range of services available to both firms’ clients.” the firm said in a release. “The addition of Cox Smith’s 118 lawyers will give the combined firm more than 450 attorneys in 15 offices. In Texas, the firm will initially operate under the name Dykema Cox Smith. The combination, which takes effect May 1, will double the size of each firm’s Dallas presence, and San Antonio will become one of Dykema’s largest offices.”

PayPal Appoints GC and SVP of Strategy and Growth

PayPal announced two new leaders will be joining the company as it prepares to separate from eBay Inc. and become an independent, publicly-traded company later this year. StreetInsider.comn reports that both will report to PayPal president and CEO designee Dan Schulman and serve on the company’s leadership team.

Louise Pentland will become PayPal’s new General Counsel, effective April 27. Pentland is the former Executive Vice President and Chief Legal Officer at Nokia Corporation, the report says.

Jonathan Auerbach will become PayPal’s new Senior Vice President of Strategy and Growth.

NLRB Files Brief Supporting Unions’ Suit, Calling County Right-to-Work Laws Preempted

The National Labor Relations Board urged a federal district court in Kentucky to invalidate a county ordinance that prohibits the use of union-security provisions in collective bargaining agreements and regulates other practices that are either permitted or prohibited by federal law, reports Bloomberg BNA.

“Hardin County’s Ordinance 300 is preempted by the National Labor Relations Act, the board argued in a proposed amicus brief it submitted to the U.S. District Court for the Western District of Kentucky. The court is considering a lawsuit the United Auto Workers and other unions filed in January to challenge the ordinance,” the report says.

Supreme Court Opens Door to Increased Role for State Courts, Regulators in the Energy Sector

A U.S. Supreme Court ruling provides states a greater role in regulating the energy sector, reports Cozen O’Connor.

“In ONEOK, the Court held that states can regulate activities that affect both wholesale and retail transactions to the extent that the regulations do not conflict with Federal Energy Regulatory Commission (FERC) regulations. In so doing, wide swaths of conduct continue to be subject to both state energy regulations and generally applicable state laws,” wrote Jonathan M. Grossman and Thomas Ingalls. “While the ruling ensures retail customers a remedy for business practices that are proscribed by state law, it may also subject conduct otherwise permitted by FERC to civil liability if that conduct affects retail transactions. This decision may also hold implications for similar regulatory regimes, such as the Federal Power Act (FPA).”

The decision upheld a lower court decision that allowed a greater role for state courts in regulating the energy sectorfinding that state laws may apply to conduct that affects both wholesale and retail transactions provided those laws do not conflict with FERC regulations. The Court rejected a bid by FERC and natural gas wholesalers to exempt from all state regulation activities that affect both types of sales, the report says.

DLA Piper has announced today that Eric Goldberg has joined the firm’s Restructuring practice as a partner in the Los Angeles office.

Goldberg represents debtors both in and out of court, as well as creditors and other stakeholders, including lenders and funds, in a variety of transactions. His practice involves complex bankruptcy-related litigation, including contested confirmations, adversary proceedings, and working with hedge funds, bondholders and buyers of distressed assets.

“Eric has deep relationships with a number of lenders and investors, as well as funds that are active in distressed markets across the country,” said Gregg Galardi, co-chair of DLA Piper’s global and US Restructuring practices. “He will be instrumental in helping clients avoid pitfalls when buying distressed companies or their assets, as well as handling bankruptcy litigation and out-of-court restructurings.”

Department of Labor Targets Oil and Gas Industry for Wage-Hour Compliance

Hard HatThe U.S. Department of Labor recently announced the results of a 2014 enforcement initiative that focused on the oil and gas industry in New Mexico and west Texas, an effort that recovered more than $1.3 million owed to some 1,300 employees as a result of this investigation.

On its website, Vorys, Sater, Seymour and Pease said this is not the first DOL foray into wage-and-hour practices within the oil and gas industry. In December 2014, the DOL announced that employers engaged in natural gas extraction in the Marcellus Shale region of Pennsylvania and West Virginia agreed to pay $4,498,547 in back wages to 5,310 employees.

Recent Acquisitions Suggest Patent Market is Alive

Recent intellectual property transactions through the first wuarter of 2015 indicate there are at least some signs that the patent marketplace is becoming more active, writes Gene Quinn at IPWatchdog.

“There have been a number of high profile acquisitions in the pharmaceutical space over the last four months, and last week Sony acquired OnLive’s patent portfolio,” he writes. And Akamai Technologies Inc. announced that it had acquired Octoshape, which will give Akamai access to Octoshape technologies that optimize the quality of video streams for over-the-top content and to enable Internet Protocol television solutions.

And over the last several months there have been a number of blockbuster deals in the pharmaceutical sector.
