N.J. Lawyer Accused in Sex for Legal Services Sting Found Dead

Richard SchubachA New Jersey attorney accused of offering to represent female clients at a reduced rate in exchange for sexual favors was found dead in his vehicle Tuesday morning from an apparent self-inflicted gunshot wound to his chest, the Somerset County Prosecutor’s Office has confirmed.

A report on NJ.com says Richard P. Schubach, 58, of Stockton was arrested and charged Monday with three counts of fourth-degree criminal sexual contact after he allegedly propositioned a female undercover detective in a sting operation, according to a news release issued Monday.

In a release, Hall Estill said that, as a litigator in private practice, Rudnicki has represented, counseled and advised a diverse range of clients, from small independent businesses to Fortune 500 companies in various disputes in front of state courts, federal multi-district panels, arbitration panels, and local and federal administrative agencies. Most recently, her practice has focused on general advice, litigation, and dispute resolution for oil and gas clients, including, landowner/joint venture disputes, drilling in city limits, alleged breach of joint operating agreements and lease agreements, issues related to horizontal drilling, fracking and disposal wells (water pollution/earthquakes), and royalty/JIB accounting disputes.

Andre Fiebig, a partner in Quarles & Brady LLP’s Business Law practice group, has recently published two books. He co-authored the fourth edition (2016) of one of the leading works on international antitrust: “Antitrust and American Business Abroad,” published by Thomson Reuters, and is the author of “EU Business Law,” published by the Business Law Section of the American Bar Association.

“Antitrust and American Business Abroad: (4th ed. 2016) builds upon the work of previous editions and discusses recent developments in the ever-changing world of international antitrust law. Florida Lawyer Permanently Disbarred for Role in DUI Setup

Stephen Diaco, one of three lawyers accused of setting up a rival’s DUI arrest, was permanently disbarred Thursday by the Florida Supreme Court, reports The Tampa Tribune.

The case began with a civil lawsuit in which Diaco and two other lawyers represented a radio personality who was the defendant in a slander suit. “But during the trial, [the plaintiff’s] lawyer, C. Phillip Campbell, was arrested for DUI. The state bar accused the Diaco firm of orchestrating the arrest by having a paralegal ply Campbell with liquor and then trick him into moving her car when a friend on the Tampa Police Department was waiting to catch him,” The Tribune reports.

The two other lawyers remain temporarily suspended.

Disbarred Lawyer Gets 30 Days for Theft of Blind Client’s $400k Inheritance

A California lawyer charged with stealing $400,000 from a client —and later suing his client after she complained to state bar authorities — has been sentenced to 30 days in jail after pleading no contest to two felony theft charges, reports The Contra Costa Times.

“On Oct. 27, 2008, Janet Stites’ mother died and left her an inheritance of more than $400,000,” according to the report. “Stites, who is blind, hired an attorney, but on the advice of her friend Richard Stickney, she fired that attorney and hired 56-year-old Concord lawyer Timothy Darden to set up two trusts for her. Within a year, Darden had allegedly swindled $438,000 from Stites and $33,500 from Stickney, and days after they complained to the State Bar of California, he turned around and sued them for fraud.”

Judge Sanctions Prominent Dallas Lawyer for Misconduct

In a scathing ruling issued Friday, a state judge in Lubbock declared that prominent Dallas trial lawyer Bill Brewer committed misconduct when he used so-called push polling to improperly influence potential jurors in a West Texas wrongful death and products liability case, reports The Dallas Morning News.

“State District Judge Ruben Reyes described Brewer’s conduct as ‘unprofessional’ and ‘unethical’ — findings that Brewer adamantly denies — and ordered the hard-charging trial lawyer to pay more than $133,000 in sanctions and take 10 hours of legal ethics courses,” according to the report.

Brewer and his law firm conducted a push poll with questions and statements “designed to influence or alter the opinion or attitude of the person being polled,” the judge ruled.

Rudy Giuliani Leaves Bracewell’s for New Crisis Management Role

Former New York City mayor Rudy Giuliani is leaving Houston-based Bracewell Giuliani to join New York-based Greenberg Traurig as global chair of their cybersecurity and crisis management practice.

Bracewell & Giuliani LLP will be known as just Bracewell after Giuliani’s departure, reports the Houston Business Journal.

In a statement, the firm said Giuliani is leaving by amicable agreement, effective Jan. 19. In a separate statement, Greenberg Traurig LLP announced Giuliani has joined its New York office as global chair of the firm’s cybersecurity and crisis management practice and senior adviser.

Termination Clause in Contingent Fee Contract Is Invalid

A fired contingent fee attorney can’t enforce a provision in his fee agreement requiring a client to pay the lawyer 20 percent of his eventual recovery if the client changes counsel, a divided Pennsylvania Superior Court declared Jan. 5, reports Bloomberg BNA.

“Enforcing the termination provision would penalize the client for exercising his absolute right to end the attorney-client relationship, Judge Kate Ford Elliott said in the majority opinion. In this situation, Elliott said, lawyers are limited to recapturing the reasonable value of their services, but that award can reflect the extent of the lawyer’s contribution to obtaining the client’s recovery,” the report explains.

“Just as a lawyer may not charge an exorbitant fee or place a ‘no termination’ clause in the contract or assert a vested interest in a client’s claim, a lawyer may not penalize a client for discharging him or her,” Elliott wrote.

She is committed to mentoring junior attorneys and law school students and has been involved in such programs with Tulane Law School and Louisiana State University Law School. Texas Law Firm GODWIN PC Names R. Alan York Managing Shareholder, COO

York succeeds Godwin as Managing Shareholder. Godwin will continue in his roles as Chairman and CEO.

Rounding out the firm’s Executive Committee, Bruce W. Bowman Jr. will continue in his dual role as Executive Vice President and General Counsel, while Jenny L. Martinez will maintain her position as Executive Vice President and Secretary/Treasurer.

In addition to his roles as Managing Shareholder, President and COO, York will continue to serve as Chair of the GODWIN PC Appellate Practice Section. Board Certified in Civil Appellate Law by the Texas Board of Legal Specialization, York provides trial support and error preservation, as well as appellate briefing and argument, on significant civil cases.

York has earned selection to The Best Lawyers in America for the past two years.
