Foley Looks to Texas, Mexico Markets with Gardere Merger Talks

Above the Law is reporting that Foley & Lardner is in merger talks with Texas firm Gardere Wynne Sewell.

“When you consider that Gardere just last month took on Bufete Hernández Romo, a Mexico City commercial arbitration and litigation boutique, it seems Foley might be very interested in moving into the hopping Texas and Mexico markets, both areas where the 19-office Foley has no presence today,” writes Joe Patrice.

The reporter points out that Foley has seen a couple of big-ticket merger attempts fail during the past few years.

Florida Law Firm Fined $9 Million By Federal Court Over Tobacco Litigation

First Coast News reports that federal judges in Florida handed down $9,164,404.12 in fines Wednesday on prominent Jacksonville litigation firm, Farah & Farah, P.A.

Farah & Farah and the Wilner Firm filed 1,250 frivolous tobacco claims against the Engle Trust Fund, the court found.

“Engle is a class action lawsuit named for a Miami pediatrician who defeated tobacco companies in court,” First Coast News explains. “A multi-million dollar fund paid by tobacco companies was set up for Floridians and their survivors who suffered illnesses due to cigarette smoking from 1994-2006. The class action in 2008 was estimated to include 700,000 people.”

Some cases filed by the attorneys were for deceased clients, non-smokers, those who did not suffer from one of the required diseases, and 572 that did not authorize the attorneys to file lawsuits on their behalf, the report says.

Survey Ranks Dallas Law Firm Bailey Brauer Among Most Feared by Opponents

The Dallas-based trial and appellate law firm Bailey Brauer PLLC has again earned a spot among an elite group of firms that corporate lawyers most fear facing in court.

According to a release from the firm, Bailey Brauer, founded in 2913, is among the youngest and smallest firms included on BTI Litigation Outlook 2018’s Honor Roll of the nation’s Most Feared Law Firms. This is the second time the firm has been recognized for its complex commercial litigation, class action and other litigation work. Selection is based upon interviews with general counsel and in-house litigation leaders nationwide who were asked which lawyers they would least like to face in litigation.

DLA Piper Litigation Practice Recognized By BTI Consulting

DLA Piper has been recognized as a “powerhouse” law firm for class actions and complex commercial litigation by BTI Consulting Group in its recently published BTI Litigation Outlook 2018 report.

The firm was also named a “standout” in IP litigation, securities and finance litigation, complex employment litigation, everyday employment litigation, product liability litigation and everyday commercial litigation. DLA Piper was one of eight firms to be recognized as a “BTI Awesome Opponent,” a category that includes firms clients said they least hope to see on the other side of the table.

Squire Patton Boggs Fights for Domain Name With Chinese Imitator

International law and lobbying firm Squire Patton Boggs hit another roadblock in its fight with a Chinese entity when a panel concluded that the current trademark holder in China maintained rights in the domain and dismissed the complaint.

World Trademark Review reports that a Chinese company appears to be practicing law using the same name and logo as that of the established firm Squire Patton Boggs, promoting its practice on a website located at squirepattonboggs.net.

“Delving deeper, we discovered the Chinese company is the same one that had previously used the brand of another international law firm, Norton Rose Fulbright (we reported on this a year prior),” writes Tim Lince. “Much of the text used on the Chinese company’s website was lifted from other law firm sites, and many of the images were either stock images or taken from movie posters, including those on the staff page.”

Dykema to Receive Texas Appleseed Pro Bono Leadership Award

National law firm Dykema announced that it has been chosen by Texas Appleseed’s Board of Directors as one of three law firms to receive the organization’s Pro Bono Leadership Award. Texas Lawyer Names Bracewell Large Firm Litigation Department of the Year

Bracewell LLP’s litigation practice has been named the 2017 “Large Law Firm Litigation Department of the Year” by Texas Lawyer.

The publication will profile the firm in the August edition.

Bailey Brauer Ranked Among Top Firms in U.S. for Client Relationships

Dallas-based litigation boutique Bailey Brauer PLLC has been selected to BTI Consulting Group’s 2017 ranking of the top 10 law firms in the country with the best client relationships within the consumer goods industry.

BTI’s inaugural guide, Industry Power Rankings: The Law Firms with the Best Client Relationships, is based on a survey of corporate counsel and executives at the world’s largest organizations representing 18 different industries.

Miller & Chevalier Elects New Leadership

Miller & Chevalier Chartered announced that the firm’s members elected Marc J. Gerson, member and vice chair of the Tax Department, as chair of the firm effective July 1, 2017. Gerson will assume the role following the lengthy and venerable tenure of current Chair Anthony F. Shelley, who steps down after 10 years of service on the Executive Committee, including almost six years as chair.

Gerson was an Associate at Miller & Chevalier starting in 1995 and rejoined the firm in 2007 after serving as Majority Tax Counsel to the U.S. House of Representatives Committee on Ways and Means. In that role, he acted as the staff liaison to Committee on Ways and Means members, the U.S. Senate Committee on Finance, the Joint Committee on Taxation, and the U.S. Department of the Treasury, and served as counsel on all major tax legislation enacted in the 109th Congress. Simon Greenstone Earns 2016 Top Verdict Recognition in California, Arizona

TopVerdict.com has recognized Dallas trial law firm Simon Greenstone Panatier Bartlett, P.C. for securing the largest jury verdict in Arizona, and the largest asbestos case verdict in California, in 2016.

In Arizona, a federal jury awarded $17 million to the family of a retired civilian employee of the U.S. Navy who died from mesothelioma after working for years in the Norfolk Naval Shipyard in Virginia. The case was Coulbourn v. Crane in the U.S. District Court for the District of Arizona.

In a news release, the firm said attorneys David C. Greenstone, Jordan Blumenfield-James and Samuel Iola represented George Coulbourn’s family. Coulbourn, a shipyard machinist, repaired and maintained equipment including the removal of asbestos-containing gaskets and packing from valves. He died at age 73, less than a year after being diagnosed. After a three-week trial, jurors found Crane Co. and William Powell Co. liable for Coulbourn’s death and assessed punitive damages against both defendants.

In California, a Los Angeles jury awarded $18 million, a record verdict in a mesothelioma case tied to cosmetic talc. The case involved Philip Depoian, a prominent political figure and longtime aide to Mayor Tom Bradley, who was diagnosed with mesothelioma in May 2015.

Evidence showed Depoian was exposed to asbestos in talc products at a barber shop and through personal use of products such as Old Spice, Clubman, Kings Men and Mennen Shave Talc. Jurors found talc supplier Whittaker Clark & Daniels liable for supplying asbestos-containing talc to the manufacturers. Attorneys Jay Stuemke and Stuart Purdy represented Depoian in the case, Depoian v. American International Industries, Inc., in Los Angeles Superior Court.

Buchalter Expands In Northern California

Buchalter announces that Matthew S. Covington and Jeffrey M. Hamerling have joined the San Francisco office, and Alissa Pleau-Fuller has joined the Sacramento office. All are members of the Litigation Practice Group and joined from Archer Norris.

Prior to Archer Norris, both Covington and Hamerling were Partners with DLA Piper.

Buchalter also announced that it added an attorney in San Francisco to its Insolvency & Financial Law Practice, Jeannie Kim.

As a result of their industry acumen, both Covington and Hamerling devote significant portions of their practices to petroleum companies, focusing on franchise, distribution, commercial and environmental matters. Both are also known for their experience with the Petroleum Marketing Practices Act, having handled cases that established major precedents in the petroleum retail industry.

Hogan Lovells Combines with Collora, Adding Boston Office

Global law firm Hogan Lovells announced that it will combine with Collora, a Boston-based litigation/investigations firm with a strong focus in life sciences and healthcare, as well as financial services and technology. The combination is expected to become effective Sept. 1, at which time all partners, lawyers, and business services members of Collora will join Hogan Lovells, the firm said in a news release.

Freeborn & Peters Opens Tampa Office

Freeborn & Peters LLP has opened its first office in Florida, located in the Tampa City Center.

The firm’s Tampa office will be led by two veteran attorneys, Lawrence “Larry” P. Ingram and Jessica Kirkwood Alley. The pair have experience in client advocacy, litigation, particularly in professional liability, third-party insurance coverage, qui tam, healthcare fraud and restrictive covenant disputes.

In a release, the firm said Freeborn’s new location also helps to address increased demand for the firm’s services in the Southeastern region of the United States, where Freeborn has existing clients. The firm also will seek to expand by assisting new clients, particularly in litigation, real estate and corporate transactions.

Larry Ingram joins Freeborn from Phelps Dunbar LLP where, as founder of that firm’s Tampa office, he served as both Office Managing Partner and Regional Practice Coordinator. He concentrates his trial and counseling practice in professional liability, third-party insurance coverage, qui tam, healthcare fraud and restrictive covenant disputes. Mr. Ingram joins Freeborn as a Partner of the firm and as the Tampa’s office’s Managing Partner.

Ms. Alley concentrates her practice on complex commercial litigation and focuses in the areas of professional liability, qui tam defense and third-party insurance coverage litigation.
