Reducing the Challenges of Cross-Border eDiscovery

The proliferation of electronic data and complexity in international privacy laws only add to the burden and cost of litigation. Given the increased legal, regulatory, and reputational complexity and risk, organizations need to be prepared to take a proactive approach to cross-border eDiscovery,” Mitchell explains.

He says the biggest challenge in cross-border eDiscovery is a lack of understanding of data privacy laws in different jurisdictions.

“Due to the nature of litigation, cross-border eDiscovery often places U.S. corporations in the tumultuous position of potentially violating foreign privacy laws. Broadly speaking, the U.S takes a different and less restrained approach to data privacy compared to the rest of the world and many countries view this approach as inadequate,” Mitchell writes.

2017 Corporate E-Discovery Hero Award Winners Honored

During the awards segment, Hon. Shira A. Scheindlin (Ret.) presented Michael Arkfeld with the Lifetime Achievement Award in recognition of his work advancing electronic discovery. Arkfeld, author of the comprehensive treatise Arkfeld on Electronic Discovery and Evidence, is Founder and Director of Education for the eDiscovery Education Center and Director of the Arkfeld eDiscovery and Digital Program at the Sandra Day O’Connor College of Law at Arizona State University.

The celebration featured a keynote chat via satellite with NPR’s award-winning legal affairs correspondent, Nina Totenberg, moderated by Craig Ball. Totenberg described history-making events that shaped her career, including those involving Anita Hill and Justice Clarence Thomas, J. Edgar Hoover, Ruth Bader Ginsburg and Stradivarius. She also shared insights about President Trump’s nomination for the open position on the Supreme Court.

Exterro Survey of Federal Judges Shows Gain in E-Discovery Competency

Exterro Inc. has released the results of its Third Annual Federal Judges Survey: E-Discovery Advice for Becoming a Better Attorney, yielding key takeaways on e-discovery competency, areas for improvement, and new FRCP rules — one year later.

Twenty-two federal judges completed this year’s survey, conducted by Exterro, answering 25 questions about the state of e-discovery. In addition to data from each question, the published report includes expert commentary from retired federal judges and industry thought-leaders, Exterro says in a release.

On the question of e-discovery competency, most respondents said that the typical attorney does not possess the subject matter knowledge required to counsel clients effectively on e-discovery matters.

Most respondents indicated that applying the principles of cooperation and proportionality is the area that offers the greatest potential for improvement among counsel.

And 82% of the judges surveyed believe that the new FRCP rules have helped solve many current e-discovery problems.

E-Discovery Hero Award Finalists Named, Michael Arkfeld Wins Lifetime Achievement Award

Brad Ellis received both his Juris Doctorate and a Master of Law in Taxation from the University of San Diego School of Law. Prior to joining Scripps Health he was in private practice with a focus in healthcare and the banking industries. The New Law Department Professional: Transforming Legal to Run as a Business Unit
