Warriors For Clients: Lyons & Simmons Share the Same Vision

When Michael Lyons left a large firm to start a trial firm in 2008, he had a simple mindset that captured everything about his practice. Simply stated, he believed he was a warrior for his clients’ causes. “My clients’ problems are my problems, and we have that approach to everything we do,” said Lyons. Twelve years later, when Lyons joined forces with Chris Simmons, that same mindset continues on times two. “We match our clients’ problems with the kind of tenacity and seriousness every case deserves, and the results we’ve obtained speak to that.”

That could not be truer when you look at the cases that Lyons and Simmons have handled over the last several years. “We’ve been involved in some of the most consequential and technically challenging cases, not just in Texas but around the country, and we’ve seen the difference it’s made in the lives of our clients,” said Lyons. “With Lyons & Simmons, we plan to continue that track record of excellence.”

Lyons and Simmons were previously partners at the Dallas-based trial boutique Lyons & Simmons, LLP. By example, here is a cross section of some of their cases just over the past five years:

  • Wrongful Death: Worker killed in a gas well blow-out in Quinton, Oklahoma; the deadliest oil and gas disaster since the 2010 Deepwater Horizon explosion
  • Breach of Fiduciary Duty: A nine-figure fraud and breach of fiduciary duty case involving a complex series of aviation transactions
  • Sexual Assault: Disabled person was sexually assaulted in her home by employee of cable installer
  • Breach of Contract: Former Power 5 head football coach sued university over the failure to pay liquidated damages provisions in his written contract
  • Wrongful Death: Patron drowned in spa’s unsupervised aquatic sensory deprivation tank
  • Catastrophic Personal Injury: Former lead singer of a rock band sustained life-altering injuries when she was crushed by motorist in parking lot
  • Brain Injury: 3-year-old child sustained catastrophic brain injuries after being struck by falling tree limb on a playground
  • Catastrophic Personal Injury: 2-year-old child sustained life-altering injuries by defectively designed and installed gate operator
  • Gross Negligence: Teenager sustained life-altering brain injuries when she was struck by delivery driver who was intoxicated, distracted and on the wrong side of the road
  • Airplane Crash: Man was killed along with two others when multiple system failures occurred mid-air in instrument conditions

Together with senior counsel Chris Carr and Stephen Higdon, who has joined the firm as an associate, Lyons & Simmons will continue to focus its practice on wrongful death, personal injury and products liability litigation along with “bet the company” type business disputes.

“For Mike and I, the goal is to level the playing field,” said Simmons. “Our clients are often facing the most challenging situation they will ever encounter when we’re brought in to help. So we have a tremendous responsibility to do everything we can to get the best possible outcome.”

Already with a reputation for huge outcomes on the biggest cases, Lyons & Simmons is poised to continue the crusade for their clients’ causes — even if that means a little less sleep.

The National Board of Trial Advocacy (NBTA) is pleased to announce that Tom D’Amore of D’Amore Law Group, P.C. has successfully achieved recertification as a civil trial, civil practice and truck accident law advocate. The NBTA was formed out of a strong conviction that both the law profession and its clients would benefit from an organization designed specifically to create an objective set of standards illustrating an attorney’s experience and expertise in the practice of trial law.

D’Amore is part of a growing number of trial attorneys that have illustrated their commitment to bettering the legal profession by successfully completing a rigorous application process and providing the consumer of legal services with an objective measure by which to choose qualified and experienced legal counsel.

Harrity Gives Back With Covid-19 Relief

Harrity4Charity COVID-19 ReliefHarrity & Harrity, LLP, a boutique IP firm specializing in patent preparation and prosecution, is taking action to help those who have been affected by the severe outbreak of COVID-19. While the firm says it is fortunate to be in an industry that is minimally impacted by the devastation of the virus, it recognizes all of those who have lost their jobs, shuttered their businesses, and/or are struggling to make ends meet during this period of uncertainty.

“Look, we are blessed to be in an industry where many, if not most, make six or seven figures. Most lawyers will make it through this pandemic relatively unscathed,” said John Harrity, Managing Partner. “We are in an unprecedented time, with a virus that is spreading throughout the world at an exponential rate and the global economy being devastated. This is a great opportunity for our legal industry to act.”

The government’s stimulus package is certainly a step in the right direction to help those that have been financially impacted by the coronavirus, but it is clear that more needs to be done. Accordingly, John said his firm has made the decision to temporarily reallocate its giving back initiative, Harrity 4 Charity, to help those suffering from the many adverse effects of COVID-19.

“As a result of the current pandemic, we have decided to pause our contributions to our partner charities and instead get our Harrity 4 Charity dollars out into the communities to help people who have been financially impacted by the coronavirus,” stated John.

Currently, the firm commits 5 percent of its profits to four charity organizations. Impressively, every one of the firm’s 53 employees also donates a portion of their paychecks to the Harrity 4 Charity non-profits. While these charities are still incredibly important to the firm, the current economic climate calls for immediate attention. Suggestions and nominations of where to donate the Harrity 4 Charity dollars have flooded in from the firm’s employees, many with heartfelt accounts of families that they know personally who are struggling to get by.

While Harrity & Harrity has not yet announced the recipients of the COVID-19 relief fund, the initiative will focus on helping families and individuals who have been laid off or lost their jobs, single parents or families struggling to provide for their children as a result of COVID-19, and those with underlying health conditions that prevent them from obtaining household essentials on their own.

The firm additionally plans on establishing restaurant-run food banks throughout the nation with the goal of helping businesses who are suffering from a lack of customers, while providing free meals to people who cannot afford them. Harrity 4 Charity will purchase meals from local restaurants and donate the food to those in need.

John hopes these programs will not only aid those suffering from the effects of the outbreak, but inspire others, specifically in less impacted industries like the legal field, to act.

“If you are in the position to, please also consider donating to one of the many organizations currently supporting COVID-19 relief, or offering to help someone you know in need,” John urges.

About Harrity 4 Charity
Harrity 4 Charity represents a partnering of law firm Harrity & Harrity, LLP, with charities that are near and dear to our hearts. Harrity pledges to give five percent of profits to partner charities and all Harrity employees pledge to donate a portion of their paychecks. Greenberg Traurig Celebrates Victory for Chalker Energy

AUSTIN – March 19, 2020 – Global law firm Greenberg Traurig, LLP vindicated Chalker Energy’s rights obtaining a major decision from the Texas Supreme Court.

Greenberg TraurigAfter seven years, the $240 million-dollar landmark case that came from the Court of Appeals for the First District of Texas came to an end. The central argument brought before the court was the effect of unambiguous contract language precluding the creation of any agreement or legal obligations during negotiations unless and until a “definitive agreement” was executed and delivered by the parties.

Greenberg Traurig attorneys Kendyl T. Hanks and Dale Wainwright argued the appeal on behalf of Chalker Energy and successfully convinced the court that, as a matter of law, a piece of an email communication with a losing bidder in negotiations for valuable oil and gas assets in the Texas Panhandle did not constitute a definitive agreement. Thus, Chalker Energy was free to strike a deal with another buyer.

“Contracting parties in all industries across the state of Texas needed to hear that a clear condition precedent to formation of a contract will be enforced,” said Hanks and Wainwright. “We couldn’t be more pleased with the Texas Supreme Court’s ruling and the clarification and certainty it will bring to future negotiations in industries.”

Read the court opinion here.

Hanks is an experienced business litigator and appellate advocate who is licensed in Texas and New York and represents clients throughout the country in state and federal forums. She represents clients from entrepreneurs, investors, executives and partnerships to Fortune 500 companies and burgeoning multinational firms.

Wainwright, co-chair of the firm’s National Appellate Practice, has more than three decades of experience. Corporate Need for Legal Guidance on Global Trade Rises With Increased CFIUS and OFAC Oversight

Lowenstein Sandler’s Global Trade & Policy group adds to its ranks Christian C. Contardo, who joins the firm’s Washington, D.C., office after over a decade of experience in federal agencies such as Treasury, the Department of Homeland Security, and Immigration and Customs Enforcement. Christian most recently served as Attorney Advisor in various Treasury offices, including the Office of Foreign Assets Control (OFAC), where he counseled on economic sanctions, Committee on Foreign Investment in the United States (CFIUS) matters, counterintelligence/insider threat programs, anti-money laundering, security clearance investigations, information security, and data privacy.

Why it matters:
The United States is both the largest recipient of foreign direct investment and the world’s largest investor in overseas businesses. In the last few years, the Treasury Department and the Department of Justice have responded to this trend by strengthening their enforcement teams and announcing more stringent compliance best practices. CFIUS has dramatically increased its review of deals involving both foreign investment and foreign investors, with a growing number of transactions at risk of being suspended or blocked.

As government scrutiny of global transactions rises, tech startups, private equity firms, hedge funds, C-suite executives, and other stakeholders engaged in international business must comply with ever-tougher CFIUS and OFAC regulations to avoid potentially devastating impacts on their investments and operations abroad. They need guidance in order to navigate the complex world of sanctions, tariffs, and investment restrictions under the Treasury Department’s evolving regulatory regime.

What:
Lowenstein Sandler’s Global Trade & Policy practice is expanding to meet this burgeoning need. In 2019 alone, Lowenstein completed over 500 venture-backed deals involving some of today’s most innovative companies. Its private equity and M&A teams handled a record-breaking number of deals, including numerous large-scale cross-border matters worth billions of dollars both for strategic acquirers and investment funds.

The firm’s global trade lawyers support these transactions by ensuring that clients and portfolio companies understand tariff engineering, country of origin requirements, OFAC sanctions, export restrictions, and CFIUS to minimize risks and maximize current and future profits. They help them to implement consistent and forward-thinking compliance programs and to anticipate supply chain issues and foreign investment requirements so that clients can plan for the future.

How:
The firm’s ranks are growing with experienced professionals deeply immersed in the ever-changing policies and laws governing CFIUS foreign investment national security reviews, OFAC economic sanctions, export and import transactions, cyber security, and data privacy. Doreen M. Edelman, chair of the firm’s Global Trade & Policy practice, says, “Our corporate lawyers understand that clients need this expertise to initially analyze a proposed transaction. National security concerns can actually cause an entire transaction to unravel. And national security now includes technology companies and those with access to personal data. We need more lawyers to advise not only our venture clients, but also our hedge fund and private equity companies. CFIUS alone is becoming a routine pre-deal concern.”
