Trial Team in County Judge Clay Jenkins Mask Case Honored for Efforts

Dallas Trial Lawyers Association honors group with John Howie Award for ‘courageous pursuit of justice’

DALLAS – Lawyers representing Dallas County Judge Clay Jenkins in his legal standoff with Texas Gov. Greg Abbott over the wearing of masks to guard against COVID-19 have received the John Howie Award for their efforts.

The Dallas Trial Lawyers Association conveys the award each year to attorneys and their clients for “the courageous pursuit of justice in the face of adversity.” The award is named for renowned Dallas trial lawyer John Howie, who died in 2002.

“We decided to take this case – and do it pro bono – because we knew it was important for the health and safety of the people in Dallas County, and because it was the right thing to do,” says Charla Aldous, of AldousWalker in Dallas, who represents Judge Jenkins. Also on the trial team and receiving the award are attorneys Brent Walker, Tiffany Standly, Caleb Miller and Jeffrey Rasansky of AldousWalker, and Sean McCaffity of Sommerman, McCaffity, Quesada & Geisler. In Austin, the group includes noted appellate lawyer Doug Alexander of Alexander Dubose & Jefferson.

It is the second John Howie Award for Ms. Aldous, who first received it in 2010 in a case involving improper peer review of a doctor at UT Southwestern Medical Center in Dallas.

“I am honored to represent Judge Jenkins in something that matters as much as this case does,” says Mr. Walker.

The dispute behind this latest award began in August when, facing exponential growth in coronavirus cases, Judge Jenkins ordered people to wear masks in all public places. That led to litigation and Jenkins added Gov. Abbott as a defendant, based on the governor’s prohibition against mask mandates. The case is right now before the Texas Fifth Court of Appeals in Dallas.

“We will wait and see what the court does, but to receive this award is recognition that, no matter the outcome, we’re doing what good trial lawyers are supposed to do,” says Mr. McCaffity.

The case is Greg Abbott et al. v. Clay Jenkins, case number 05-21-00733-CV in the Texas Fifth Court of Appeals in Dallas.

Radtke’s experience includes developing distressed workout strategies for debtors and creditors, assisting clients with asset sales, and developing and implementing reorganization plans. He has also litigated contested matters in state, federal, and appellate courts, including contract disputes, UCC rights, director and officer and shareholder disputes, and multi-million dollar avoidance actions. Radtke also has extensive experience investigating fraud and pursuing rights and remedies on behalf of receivers, trustees, and other fiduciaries, including indenture trustees. His experience includes numerous proceedings and transactions with international parties and cross-border implications in North America, Asia, and Europe.

Foley Appoints New Office Managing Partners in Boston and New York

McKenna succeeds partner Susan Pravda who held the position in Boston since 2005. Pravda was recently appointed to serve as the leader of the firm’s Health Care & Life Sciences Sector and she will continue in her role as the firm’s chief strategic talent acquisition partner. Sekel succeeds Peter Wang who held the position in New York since 2004. Wang will continue to counsel clients as part of his vibrant litigation practice. They were Foley’s longest-serving office managing partners and both the first to hold the position in their respective offices.

DALLAS, November 1, 2021—Duane Morris special counsel Jason E. Boatright has been appointed to the Texas Board of Disciplinary Appeals. Boatright is a member of the firm’s Trial Practice Group and is based in its Dallas office. The Texas Board of Disciplinary Appeals is a statewide independent adjudicatory body of 12 attorneys appointed by the Supreme Court of Texas to hear certain attorney discipline cases and to promote consistency in interpretation and application of the Texas Disciplinary Rules of Professional Conduct and the Texas Rules of Disciplinary Procedure. Boatright’s three-year appointment will expire on August 31, 2024.

Boatright practices in the area of litigation. He has held senior legal positions in Texas’ state government in both Dallas and Austin. Boatright is a former justice of the Texas Fifth District Court of Appeals, the appellate court that reviews trial court decisions in Collin, Dallas, Grayson, Hunt, Kaufman and Rockwall counties. Previously, he was director of the general counsel section of the Texas Railroad Commission, the agency that regulates the Texas oil and gas industry. New NABL president Ann Fillingham focuses efforts on muni legislation

The National Association of Bond Lawyers is putting its efforts behind the industrywide push for the muni industry’s priorities to be included in the infrastructure and reconciliation bills currently passing through Congress.
Ann Fillingham, director of regulated industries at Dykema, who becomes NABL’s president this week, discussed the group’s priorities as the agency kicks off its annual Workshop conference in a dual in-person and virtual format.
Fillingham succeeds Ballard Spahr partner Teri Guarnaccia as the 11th female president of the organization and will travel to Chicago to participate in NABL U’s Workshop on Wednesday and Thursday to kick off her tenure.
“NABL’s current priorities are very consistent with the market,” she said. “We want to be nimble and helpful to both our members and to policymakers with respect to both the infrastructure and reconciliation packages.”
Her presidency comes at a critical time for the muni industry, as lawyers and other muni professionals alike are pushing the inclusion of muni provisions in President Biden’s infrastructure and reconciliation bills. Fillingham views NABL’s priorities as part of a larger industrywide push behind these issues.
“NABL really views itself as a technical expert and resource when it comes to all aspects of federal policy relating to public finance,” Fillingham said. “And we’re hopeful that everyone uses us as that kind of trusted expert voice.”
The group is committed to advocating on behalf of restoring tax-exempt advance refunding, reestablishing a direct-subsidy bond program, expanding private activity bonds and modernizing bank qualified debt, she said, all issues that the muni industry has been buzzing about for years.
“We’re committed to preserving existing finance tools for state and local governments, as well as expanding and exploring new tools to help build strong economically vibrant communities,” Fillingham said.
These aren’t new issues for NABL and are consistent with where the organization and the organization’s board has been over the last few years. But since so much change could come as a result of the upcoming legislation, Fillingham said she’s making sure all NABL members are up to date with the current tools in the market, as well as the potential for new ones that may “improve the state of the art in our field,” she said.
Fillingham grew up in Midland, Michigan, where her father was an inorganic research chemist for the Dow Chemical Company. Her studies led her to Michigan State University, where she began a degree in finance.
While initially “uncertain about what she wanted to do,” Fillingham said, she spent a summer working for a sole practitioner in her hometown and from there, decided that a career in law was the right path for her.
Following graduation, Fillingham went on to pursue a law degree from the University of Michigan and was introduced to NABL in 1991, when she attended a fundamentals of municipal bond law seminar hosted by the agency and was struck by the ins and outs of the muni industry.
“I enjoyed that seminar immensely,” Fillingham said. “I still have that dog-eared blue book on my desk literally 30 years later and was very impressed by how professional and forthcoming everyone was with information and advice when I was in my 20s, and continue to be so in my 50s.”
Fillingham currently resides in Lansing, Michigan and being in the state capital has given her exposure to work with the state and some of its agencies, gaining her first experience with the muni industry working with the Michigan Finance Authority, which was then called the Michigan Municipal Bond Authority, in an issuance for Wayne County.
“I found it fascinating to be able to use both my legal and my finance skill set meaningfully at this local government,” she said. “And I still do.”
This week’s conference will take place through a hybrid in-person and virtual model, after last year’s conference was done all virtually.
This format, Fillingham said, has “inserted a level of complication into the conference planning process but we feel it’s important to be able to reach our members, regardless of their comfort of being in person at the moment or not.”
“Mostly it has changed backroom and operational types of things,” she added. “We’ve worked very hard to make sure that it hasn’t and won’t adversely affect content and delivery, but the mechanics of both in-person delivery and electronic delivery are a little more complicated from an organizational perspective.”
The last year and half of uncertainty in the market has forced many to think about the market and their role in it in new ways, and that remains true for NABL as well. But the organization is not changing its governing structure or staffing operations like others in these unprecedented times; it’s doubling down on what has made the organization an effective resource throughout the years.
“It certainly has created for all of us a heightened awareness of the need to think about the different ways that membership utilizes NABL and the NABL resources, and really focus on making sure as an organization we remain relevant to and helpful for our membership,” Fillingham said.

Lewis works with the firm’s Government and Regulatory Affairs practice and Gentry Locke Consulting, using research and strategy to help clients achieve their legal and policy goals. She recently served as a senior advisor for SIR, Inc. a strategic marketing and communications firm; as an outreach representative for United States Senator Mark R. Warner, serving Central and Southcentral Virginia; and as the legislative assistant to former Virginia Delegate Onzlee Ware. Lewis received her B.A. from the University of Virginia and her J.D. from Regent University School of Law. Lewis is licensed to practice law in Maryland and Virginia.

Morrison has joined the firm’s Medical Malpractice group. Prior to joining Gentry Locke, Morrison served as a judicial clerk for the 23rd Judicial Circuit of Virginia. During law school he worked as a summer law clerk at a Virginia Beach firm, as an intern and third year practitioner at the U.S. Attorney’s Office for the Eastern District of Virginia, and as a judicial intern for The Honorable Robert J. Humphreys, Court of Appeals of Virginia. Morrison graduated with a B.A. from Radford University and earned his J.D. at the Regent University School of Law, where he graduated first in his class.

Santos has joined the firm’s Insurance practice. During law school she worked as a research assistant at Washington and Lee University School of Law, as an intern with a small full-service firm, and as a summer associate at Gentry Locke. She also served as a student attorney for the Virginia Capital Case Clearinghouse during her final year of law school. Prior to attending law school, Santos worked with URAC, a nonprofit healthcare accreditation organization promoting healthcare quality through leadership, accreditation, measurement, and innovation. She graduated with her B.A. from the College of William & Mary and earned her J.D. from the Washington and Lee University School of Law.

Spotswood has joined the firm’s Commercial Litigation group. While in law school, Spotswood interned with firms in Charlottesville and Radford, and he worked as a summer associate at Gentry Locke. He graduated, summa cum laude, from Virginia Tech with a B.A. and then earned his J.D., from the Marshall Wythe School of Law at the College of William & Mary.
