Gun-Maker Offers Sandy Hook Families $33 Million, Here’s What They May Be Considering

“After a years-long legal battle with the maker of the rifle used in the Sandy Hook Elementary School shooting, some of the victims’ families are deliberating over a $33 million settlement offer from Remington Arms. The offer, presented by the now-bankrupt gun-makers in court documents on Tuesday,” reports Vanessa Romo in NPR.

“Comes just a day after a judge denied the company’s request to dismiss the lawsuit. However, the sum falls far short of what families have previously said they expected. In court documents earlier this year, they argued that wrongful death settlements could reach $225 million and expected total punitive claims could exceed $1 billion.”

Tesla Owners Could Get $625 Each in Class Action Settlement Over Battery Throttling

“Some Tesla owners could get $625 each to settle claims that an over-the-air update, pushed to their Model S electric sedans in May 2019, reduced their battery’s charging speed, maximum capacity and range temporarily. According to documents filed with a U.S. District Court in San Francisco, and obtained by CNBC, the proposed settlement would have Tesla paying $1.5 million into a fund that would pay owners,” reports Lora Kolodny in CNBC.

“In May 2019, Tesla was facing negative publicity after one of its Model S vehicles caught fire in Hong Kong. Tesla issued a statement at the time, saying Out of an abundance of caution, we are revising charge and thermal management settings on Model S and Model X vehicles via an over-the-air software update that will begin rolling out today, to help further protect the battery and improve battery longevity.”

Vincent Bryan
Bryan is an associate in the Commercial Litigation practice of Chamberlain Hrdlicka. He was previously a summer associate at the firm. He focuses on commercial litigation matters, including landlord tenant, real estate and construction disputes.”.

Bryan graduated from the University of Houston Clear Lake with a bachelor’s degree in history. He recently earned his law degree magna cum laude from the South Texas College of Law, where he was also a member of the South Texas Law Review. During that time, he has also won third place in the National Appellate Advocacy Tournament for Religious Freedom in 2019 and was named the Outstanding Advocate during the Spurgeon Bell Moot Court Competition in 2019. Mike Farrell
Farrel joined Chamberlain Hrdlicka as an associate in the Tax Planning & Business Transactions Practice, where he advises corporations, partnerships, and limited liability companies on the federal income tax aspects of business transactions, including mergers, acquisitions, joint ventures, partnership arrangements, initial public offerings, and financial restructurings. He also assists taxpayers resolving federal tax controversies at all stages from audit through appeals and litigation. He will also counsel clients on development and negotiating agreements for business acquisitions and dispositions, mergers, conversions, and recapitalizations.

Farrell graduated cum laude from the University of California, Los Angeles with a bachelor’s degree in economics. He obtained his law degree, cum laude, from the University of Michigan Law School. While there he made the Dean’s List and received a Certificate of Merit Award for highest grade in Corporate Taxation. He served as an executive editor for University of Michigan Journal of Law Reform, participated in the Tax Law Society and volunteered as associate justice with the University of Michigan Central Student Judiciary. Umair Karowadia
Karowadia is an associate in the Tax Planning & Business Transactions group at Chamberlain Hrdlicka, where he focuses on entity formation, governance, internal restructuring, and business succession planning. Prior to joining the firm, he was an associate in KPMG’s M&A Tax Group.

Karowadia graduated from the University of Texas at San Antonio with a bachelor’s degree in political science. He obtained his J.D. degree cum laude from Notre Dame Law School. Christopher Langston
Joining the Commercial Litigation practice as an associate, Langston represents international and domestic entities in all phases of complex state and federal litigation, including high-stakes contract and business disputes, appeals, claims involving fraud and deceptive trade practices, shareholder and securities litigation, fiduciary duties, government and internal investigations, construction, insurance, torts, professional liability, products liability, trade secrets, and intellectual property disputes. Phillips Nizer Intellectual Property Chair Appointed to Copyright Claims Board

New York, NY (July 26, 2021) – Phillips Nizer LLP congratulates Intellectual Property Practice Group Chair Monica McCabe, who has been named by the Librarian of Congress as one of the first three copyright claims officers on the newly established Copyright Claims Board.

The Copyright Claims Board was created by Congress in December 2020, when it passed the Copyright Alternative in Small-Claims Enforcement Act of 2020 (CASE Act). The Act directed the Copyright Office to establish the Board as a tribunal to provide an efficient and user-friendly option to resolve copyright disputes of low monetary value.

Lewis Roca Announces New Leadership Appointments

Highlighting the firm’s depth of national talent, Lewis Roca has appointed two new office managing partners in its Phoenix and California offices and three new practice group leaders located in the Denver, Los Angeles and Tucson offices.

Doug Tumminello is stepping into the role of practice group leader for Litigation as former co-chair, Bob McKirgan, takes on an integral role in the recruitment of laterals for the practice. Tumminello is based in Denver and also serves as the office managing partner for the firm’s Denver and Colorado Springs offices. Britney’s New Lawyer Calls Out Biglaw Firm in Bid to End Conservatorship

“After years locked in a conservatorship, Britney Spears has a new lawyer and an opportunity to get out of the arrangement that see says leaves her with a meager stipend and involuntarily stuck on birth control. “New Hampshire bench, represents Britney in the fight now and just filed a 120-page petition to remove her father as sole conservator. The petition alleges Jamie Spears paid himself $16,000 a month more than Britney is allowed to make and took percentages from Britney’s deals as if he were a manager or agent, despite performing.”

Companies Agree to $65M Settlement Over Hoosick Falls PFAS Lawsuit

“Three companies blamed for the pollution of water supplies in and around the Rensselaer County village of Hoosick Falls have agreed to pay $65 million to settle a federal lawsuit. The deal, first reported by the Times Union, still needs court approval. It would provide money and medical monitoring for thousands of property owners and residents, according to the newspaper,” reports Jim Levulis in WAMC.

“The suit against Saint-Gobain, Honeywell International, 3M and DuPont came after PFAS contamination of the village’s water supply was first discovered in 2014. The chemicals have been linked to ill health effects, including cancer. DuPont is not part of the announced settlement.”

States Reach Settlement in Opioid Litigation; CT to Get $300M

“Connecticut is expected to receive about $300 million of a just-announced $26 billion settlement between a coalition of states and four companies that either manufactured or distributed opioid painkillers. At a press conference at the state Capitol on Wednesday, State Attorney General William Tong announced the terms of the agreement between AmerisourceBergen, Cardinal Health,” reports Zachary Vasile in Hartford Business.

“Johnson & Johnson and the dozens of state attorneys general who have accused those companies of contributing to the nation’s opioid epidemic, which according to the Centers for Disease Control has killed around 500,000 people since 1999. Connecticut has accepted the settlement, Tong said, and most other states participating in the lawsuit are expected to do the same.”

Disbarred Former Biglaw General Counsel Pleads Guilty

“The Biglaw firm of Le Clair Ryan may be gone the partners voted to dissolve the firm in 2019 but that doesn’t mean there’s nothing noteworthy going on with them. The firm’s former general counsel, Bruce Matson, was disbarred last year after allegations that he misappropriated $2.5 million in funds,” reports Kathryn Rubino in Above The Law.

“Matson had previously served as trustee for the bankruptcy of LandAmerica Financial Group LFG, and when the Chapter 11 closed in 2015, he was selected as the court-appointed trust fiduciary to oversee the wind-down. As part of those responsibilities, he was prohibited from making any distributions to himself until 2021.”
