Vail Resorts Offers $13M to Settle Class-Action Lawsuits

“Vail Resorts has extended a $13.1 million offer to settle five wage and labor lawsuits filed in California, a step that could have implications for a similar lawsuit filed in Colorado and for anyone who has worked on mountains owned by Vail Resorts in recent years. The California lawsuits are similar in many,” reports Kelly Duncan in Park Record.

No-Vax Novak Djokovic Considers Lawsuit Against Australia for $4.4M

“Tennis star Novak Djokovic is considering serving Australia’s government with a lawsuit after he was deported in the interest of public health ahead of the Australian Open. Djokovic, 34, was consulting his legal team about suing the country for $4.4 million, a fee that includes the $2.75 million prize,” reports Jessy O’Neill in New York Post.

Washington AG: $45M Settlement with Student Loan Company

“Washington state Attorney General Bob Ferguson says a major student loan servicer will provide about $45 million in debt relief and restitution to settle the state’s lawsuit that alleged it deceived loan seekers and engaged in unfair practices. It’s part of a national settlement in which Navient, which was spun off,” reports AP News in their blog.

“In a statement Thursday Ferguson said Navient will extend more than $35 million in debt relief, erasing the remaining debt of more than 1,400 people in the state who took out certain private student loans between 2002 and 2014. The average loan was about $25,000 per person. The company will also pay $2.3 million in restitution,”

Prince Estate Valued at $156.4 Million in Settlement of Years-Long IRS Dispute

Planning for College Costs Helps Avoid Legal Battles

During a divorce proceeding, much of the focus while negotiating child support is on the here and now; however, looking forward to your child’s continuing education is equally important. College costs can be a heavy burden on a household and even more so when parents are divorced.
Supporting your child, regardless of age, is seen as a parental duty, but under Florida law, there is no legal obligation for a parent to pay for college tuition or support a child after the age of eighteen or high school graduation. The Constitution’s Equal Protection Clause prohibits the courts from ordering a specific spouse to do so and can leave a family in a difficult situation as their child hits college age.
One common mistake that I have seen during my twenty-five plus years in family law is when a parent independently files to modify their child’s support obligation once their child is of college-age. There could be benefits with a change, mainly if the child goes off to college and will not be living at home, but nothing is guaranteed, and your support obligation could increase with tuition fees, living expenses, and room and board. The assumption of a change in your favor could have huge financial implications on your lifestyle. That is why seeking council from a family law and child support legal professional is so important.

As I have mentioned on other occasions, a key to future planning, whether it is has to deal with assets or financial obligations for your child, is a Marital Settlement Agreement (MSA). Guided by a legal professional, the agreement allows separated parties to negotiate a settlement that goes beyond what a judge would rule on and can help you avoid any surprises after high school graduation.
When defining the MSA, and in advance of college selection, spend time carefully analyzing future education costs for all the children involved. Suppose the payment for a college education falls to both parents based on the MSA. In that case, a reasonable metric can be used, in-state tuition, for example, to set up a guideline for allocating expenses during their college career or to a 529 fund or trust / escrow account.
The terms in an MSA should be clearly defined and include precisely what expenses will be covered and if there is a maximum amount threshold. The agreement should also clearly set forth the duration of time that payments should be made and outline any future obligations, including master’s or doctorate degree tuition residencies or relocation.
Children are a lifetime investment proposition, and the more your plan for their future education, the more your parental stock will grow.

Buchalter’s San Francisco office has recently expanded to include a number of impressive new Shareholders and attorneys, including Marlene Williams and Jenni Krengel. Williams is a member of the Intellectual Property practice group, focusing on helping clients maximize the value of their brands and copyrights and avoid risks connected with developing new brands and creative works. She collaborates with clients to strategically build trademark and copyright assets and protect the value of those assets as efficiently as possible. Her practice involves the entire life cycle of a brand, including selection, worldwide protection and enforcement.

Krengel is the Chair of the Firm’s Employee Benefits and Executive Compensation Group, advising clients on design, compliance, and operation of qualified retirement plans, health and welfare plans, and nonqualified plans. She has particular expertise representing public employee retirement systems and government employers on tax and fiduciary matters. Krengel is also widely regarded for her work as tax and fiduciary counsel to public pension plans across the country. Further, she has significant experience with IRS and DOL voluntary compliance programs, and with ERISA fiduciary rules and best practices.

Christopher Parker also recently joined Buchalter’s San Francisco office as an attorney and a member of the Energy & Natural Resources practice. He has a broad knowledge of energy regulation, financing, and transactions gained from experience as a judicial clerk for the California Public Utilities Commission (CPUC).

Ms. Adams provides tactical advice to clients on criminal matters, complex civil litigation, and internal investigations. She leverages her nearly decade-long experience as an Assistant U.S. Attorney in the Middle District of Florida to advise clients on proactive and reactive strategies for handling complex government investigations and prosecutions. Ms. Adams has additional private practice experience in Washington, D.C., defending corporate clients targeted by government investigations and class action lawsuits and preparing clients to testify before the United States Congress.

While at the U.S. Attorney’s Office, Ms. Adams prosecuted violent and organized crime and built complex cases by utilizing grand jury investigations and electronic surveillance techniques. She also chaired and participated in numerous trials, including multi-defendant racketeering (RICO) and murder trials and was recognized with the Attorney General’s Distinguished Service Award in 2016 for her work in a six-defendant RICO and murder case in which all defendants were convicted following a three-month trial.

Ms. Adams received her J.D. from the Duke University School of Law, her M.A. from Georgetown University School of Foreign Service, and her B.S. from Northwestern University.

CHICAGO (January 12, 2022) – Neal Gerber Eisenberg is pleased to announce the addition of Jeffrey S. Ward as a partner in the Intellectual Property practice group. Before joining NGE, Jeff was a partner at Green, Griffith & Borg-Breen, and Merchant & Gould.

A registered patent attorney with nearly four decades of experience, Jeff focuses on patent and trade secret litigation and strategic counseling related to pharmaceutical, chemical, biotechnology, electrical engineering, agricultural, and food products.

He has also handled all aspects of pharmaceutical patent infringement cases concerning the Hatch-Waxman Act and has litigated disputes in various federal courts throughout the United States and before the International Trade Commission. Jeff has served as lead counsel in both bench and jury trials and has extensive experience leading numerous patent appeals, including before the U.S. Court of Appeals for the Federal Circuit.
