Insurance Co Fires In-house Counsel, Ex-Big Law Attorney Spotted at Capitol Riot

“A Texas-based insurance company fired one of its senior lawyers, the company said Thursday, after the attorney was identified as one of the hundreds of supporters of U.S. President Donald Trump who stormed the U.S. Capitol a day earlier,” reports Caroline Spiezio in Thomson Reuters’ Westlaw Today.

“Goosehead Insurance said in a Thursday morning tweet that associate general counsel Paul MacNeal Davis is “no longer employed” at the company.”

“He joined the Dallas-area company in mid-2020. His profile on the State Bar of Texas website lists a number for law firm Clark Hill. Court records show he also previously worked at Andrews Kurth, since merged to become Hunton Andrews Kurth. Representatives for those firms did not immediately respond to request for comment.”

Boeing To Pay $2.5 Billion Settlement Over Deadly 737 Max Crashes

“Boeing will pay more than $2.5 billion to settle a criminal charge related to the two 737 Max plane crashes in 2018 and 2019 that killed 346 people,” reports David Schaper in NPR’s Business.

“The Justice Department has announced that it has reached a deferred prosecution agreement with Boeing to resolve a charge of criminal conspiracy to defraud the FAA.”

“Boeing admits to criminal misconduct for misleading regulators about the safety of the troubled jetliner, but the airplane manufacturer is not pleading guilty to the charge. If Boeing complies with the terms of the settlement, in three years the government will drop the criminal charge. That’s important for Boeing, a huge federal defense contractor, because a criminal conviction would prohibit the company from getting future government contracts.”

Indemnification as an Exclusive Remedy

Thou Shall Not Interfere with Special Purpose Entities’ Contractual Obligations

“A recent decision of the New York Court of Appeals, Sutton v. Pilevsky held that federal bankruptcy law does not preempt state law tortious interference claims against non-debtors who participated in a scheme that caused a debtor—in this case a bankruptcy remote special purpose entity—to breach contractual obligations intended to ensure that the entity remains a Special Purpose Entity (SPE) and to facilitate the lenders’ enforcement of remedies upon a future bankruptcy filing, if any,” discusses Dechert LLP in their Knowledge blog.

“The ruling likely has significant implications for structured finance providers and may have broader implications as well. Interestingly, in this case the defendants were strangers to SPE financing; after all, the sponsor and its related persons are usually subject to liability on the loan under standard bad acts carve-out guaranty, making it unnecessary to sue them for causes of actions outside the scope of their guaranty.”

North Texas Lawyer Who Participated in Capitol Riot Fired from his Job

“A North Texas lawyer has been fired by his employer after he was seen on video outside the Capitol building along with hundreds of other supporters of President Trump on Wednesday,” reports Domingo Ramirez Jr. in the Forth Worth Star Telegram.

“Social media posts identified the attorney as Paul Davis, who was an associate general counsel and director of human resources at Goosehead Insurance, a company based in Westlake.”

“On Wednesday, Davis posted a video on Instagram saying that he was outside the Capitol building and he had just been tear-gassed.”

After Top Staff Exodus, Texas AG Seeks $43M for Google Suit

“The mass exodus of Texas Attorney General Ken Paxton’s top staff over accusations of bribery against their former boss has left the Republican seeking $43 million in public funds to replace some of them with outside lawyers to lead a high-profile antitrust lawsuit against Google,” reports Jake Bleiberg from the Associated Press in ABC News’ U.S. News.

“Former Paxton aides told The Associated Press that before they reported him to the FBI in September and began resigning, the lawsuit against the search engine giant was set to be handled internally by what is one of the largest state attorney general’s offices in the U.S.”

“The outside lawyers’ contracts put a price tag on the fallout from Paxton’s deputies accusing him of crimes in the service of a wealthy donor who employs a woman with whom the attorney general allegedly had an extramarital affair. It remains to be seen how much taxpayers will ultimately shell out under the complex deals.”

Cliff P. Riley – Commercial Litigation; Dallas
Riley is an experienced litigator who has been trusted to litigate high-stakes cases in state and federal courts throughout Texas, with an emphasis on business disputes, real estate litigation, and appellate matters, as well as extensive experience in white collar criminal defense. He has served as lead counsel in trial court litigation and has been the lead drafter on winning briefs before the Texas Supreme Court and Texas Courts of Appeals. Several of Riley’s cases have been covered by major media.

Riley earned a J.D. from Pepperdine University School of Law and a B.A. from the University of Dallas.

Tania Shapiro-Barr, M.D. – Intellectual Property; Minneapolis
Shapiro-Barr focuses her practice on the preparation and prosecution of patent applications in technology fields including medical devices, biotechnology, and pharmaceuticals. She has experience prosecuting both foreign and domestic patent applications, as well as counseling clients and drafting opinions regarding patentability, freedom-to-operate, infringement, and validity. She also has experience with patent litigation and trademark prosecution.

Shapiro-Barr earned a J.D. from William Mitchell College of Law, an M.D. from University of Wisconsin Medical School and a B.S., Honors Program, from the University of Wisconsin-Madison.

Elizabeth A. Voss – Labor & Employment; Dallas
Voss counsels clients in a variety of industries on all aspects of employment and labor relations. She has represented employers in multiple state and federal courts, as well as in administrative proceedings with Texas Workforce Commission and the U.S. Equal Employment Opportunity Commission. Voss navigates clients through discrimination statutes, wage and hour issues, employment policies and agreements, and non-compete, non-solicitation and trade secret litigation.

About Thomas J. Snyder

Snyder earned his J.D. from Seton Hall University School of Law in 1992 and his B.S., cum laude, from Albany State University in 1987. He has served as Chair of the Family Law Section of the New Jersey State Bar Association. He has been recognized for his contributions to the enactment of legislation in the areas of irreconcilable differences, open adoption, and alimony reform. Tom has litigated landmark cases including cases presented to the New Jersey Supreme Court which have impacted international child custody litigation and litigation involving fathers’ rights to challenge false claims of paternity. He has contributed to New Jersey State Bar Association’s amicus curiae briefs in litigation involving same sex couples’ rights to a legally recognized marriage and litigation involving whether income from a discretionary trust can be used for the purposes of calculating alimony and child support. He has been recognized by the New Jersey Law Journal in 2019 with a Professional Excellence Award in Mentorship, and among many other honors, has regularly been listed by Best Lawyers in America for Family Law.

About Matheu D. Nunn

A former county and municipal prosecutor, Nunn is an experienced litigator who has tried jury and bench trials and has been counsel of record in more than 50 Appellate Division and Supreme Court matters, including precedent-setting family law decisions in Bisbing v. Bisbing, 230 N.J. 309 (2017), a child relocation case; and Quinn v. Quinn, 225 N.J. 34 (2016), a cohabitation case. Nunn’s noteworthy victories have earned him numerous awards and recognitions including consecutive selections as a New Jersey Law Journal “Attorney of the Year” finalist, recognition as a “Trailblazer” in family law by the National Law Journal, recognition in Best Lawyers in America for Family Law, and inclusion in the 2020 “40 Under 40” ranking by NJBIZ. Nunn earned his J.D., with academic honors, from Rutgers School of Law in 2007 and his B.A. from the University of Delaware in 2003. Prior to joining Einhorn Barbarito, Nunn clerked for the Hon. B.
