Brick Ability Buys Renewable Energy Products Company for up to GBP5.5 Mln

“Brick Ability Group PLC said Wednesday that it has acquired renewable energy products company HBS NE Ltd. for up to 5.5 million pounds $7.4 million as part of the company’s plan to broaden its offering to customers. The U.K. construction-materials distributor said the deal includes an initial,” reports Michael Susin in Market Watch.

“Payment of GBP3.3 million with further payments of up to GBP2.2 million over the next three years subject to performance conditions. The acquisition will be funded from existing resources and the company expects the deal to boost earnings immediately after the completion. HBS NE generated revenue of GBP8.5 million and normalized.”

West Coast Dockworkers Reject Contract Extension, Seek Talks

“The union representing about 15,000 dockworkers at the nation’s largest ports declined an offer by employers to extend existing labor contracts for a year, setting the stage for heated negotiations. The Pacific Maritime Association which represents 70 ocean carriers and terminals operating at 29,” reports Augusta Saraiva in The Seattle Times.

“West Coast ports, including Seattle and Tacoma proposed extending its current agreement with the International Longshore and Warehouse Union for another year through July 1, 2023, it said in a Nov. 16 letter to the ILWU seen by Bloomberg News. There is already a perception among the trade community that negotiations are likely to result.”

“When IATSE, the International Alliance of Theatrical Stage Employees, announced on November 15 that its members had ratified two new contracts, the statement came with an asterisk: A majority of voting members had actually voted against one of them. In the high-turnout vote, only 49.6 percent,” reports Chris Stanton in Vulture.

Judge OKs $5.4M Lowa Settlement over Transamerica Retirement Plan

“A federal judge has approved a $5.4 million settlement between Transamerica and its current and former employees who accused the company of offering several poor performing investments in its employee retirement plan. The money will be divided up between roughly 24,000 people based on,” reports WIZM News in their blog.

“How long they invested in the funds and how much money they had invested. According to the lawsuit, employees who invested in Transamerica’s retirement plan lost between $15 million and $20 million because some funds performed worse than comparable ones that employees couldn’t choose in the plan. Auto Dealer David Rosenberg Reaches $30m Settlement with Former Private-Equity Owners of Prime Motor Group

Auto dealer David Rosenberg will receive $30 million as part of a settlement of his legal claims against GPB Capital Holdings, the New York investment firm that acquired Prime Motor Group from Rosenberg and his father four years ago. The settlement was reached in time for Westwood-based Prime, a group,” reports Jon Chesto in Boston Globe.

“It’s not every day that an ex-Biglaw partner is arrested on federal cyberstalking charges and accused of launching a campaign of harassment, intimidation, and threats against his former partners, but here we are. Willie Dennis, 59, a former corporate partner at K&L Gates, was arrested last week in the,” reports Staci Zaretsky in Above The Law.

“Dominican Republic after allegedly sending an untold number of harassing, threatening, and intimidating emails and text messages to a number of people at the firm over the course of more than 18 months. The indictment against Dennis was unsealed this past Friday. Dennis, who is Black, was let go in May 2019, and he did not part.”

Jeld-Wen’s $40 Million Investor Settlement Gets Final Court Nod

“Jeld-Wen Inc. investors won final approval from a federal judge in Virginia for a $40 million class action settlement of claims that the door manufacturer kept them in the dark about its antitrust violations. Judge John A. Gibney Jr. signed off Monday on the agreement, which ends securities fraud,” reports Mike Leonard in Bloomberg Law.

“The deal calls for payments of $39.5 million by Jeld-Wen and $500,000 by Onex, according to court filings. It includes an award of $10 million in legal fees to counsel for the investors. In light of the benefits to the class and the complexity and expense of further litigation, the settlement is, in all respects, fair, reasonable, and adequate.”

NFL Seeking over $1 Billion from Insurers in Concussion Litigation Coverage

Juul to Pay Arizona $14.5 Million to Settle Lawsuit over Marketing to Youth

“E-cigarette giant Juul Labs will pay Arizona $14.5 million as part of a settlement for a lawsuit alleging it illegally targeted young people in its marketing. The company faces over 2,000 lawsuits related to its marketing practices, which included fruit-flavored liquid pods and ad buys on youth websites,” reports Shawna Chen in Yahoo News.

“$12.5 million of the settlement will be allocated to anti-addiction programs, while the remaining $2 million will help cover litigation expenses and go to a general consumer protection fund. Though Juul has admitted no wrongdoing, it called the settlement “another step in our ongoing effort to reset our company. We will continue working.”

Steptoe Announces Partner and Of Counsel Promotions for 1 January 2022

Duane Morris Welcomes Intellectual Property Partners Timothy R. Shannon and Seth S. Coburn in Boston

Timothy R. Shannon and Seth S. Coburn have joined Duane Morris LLP as partners in the firm’s Intellectual Property Practice Group in its Boston office. Prior to joining Duane Morris, Coburn and Shannon were partners at Verrill Dana LLP.

Timothy R. Shannon maintains a national patent litigation practice in a variety of high-tech fields. His practice involves extensive work in the software, electronics, LED lighting, computer chip manufacturing and medical device fields. Shannon’s complaint-to-trial experience includes sophisticated patent matters in courts across the country, from Massachusetts to Texas. Recent highlights include: first-chair leadership of a life sciences (human mesenchymal stem cells) patent inventorship trial in the United States District Court for the District of Massachusetts; a patent enforcement action involving LED lighting technology in the District of New Jersey; a patent dispute concerning genetically modified mice (Alzheimer’s model) in the Middle District of Florida; representation of a Shanghai-based computer chip manufacturer through Markman and settlement in a patent troll case in the Eastern District of Texas; representation of a North Carolina-based integrated development environment software manufacturer in a patent troll case in the Eastern District of Texas; and representation of a Toronto-based life sciences company specializing in plant-based manufacturing/gene expression of human monoclonal antibodies. He also has experience in PTAB proceedings and the International Trade Commission.

Shannon is a graduate of Harvard Law School (J.D., cum laude, 2002), Oxford University (M. St., 1997) and Yale University (B.S., 1994).

Seth S. Coburn represents clients in complex intellectual property disputes across all stages of litigation and in a range of industries and technologies, such as solid-state (i.e., LED) lighting, telecommunications, software, electronic health records, robotics, Internet of Things devices and GPS-enabled consumer goods. He handles disputes from early assessment, dispositive motions, Markman hearings, trial and through appeal. Coburn also has extensive experience defending companies against patent trolls. He is experienced in organizing and leading joint-defense groups in coordinating litigation strategy against some of the largest and sophisticated patent trolls. In addition to his federal court experience, Coburn also has experience in post-grant proceedings before the Patent Trial and Appeal Board. He has represented both patent challengers as well as patent owners and has secured favorable resolutions as a result of the proceedings. Coburn also has experience in Section 337 investigations before the International Trade Commission. He provides clients with strategic pre-litigation counsel to manage risk and develop business strategies in crowded intellectual property environments. Coburn helps clients identify key threats and develop creative and effective strategies for managing external risk. He also helps develop strategies for protecting key intellectual property assets for intellectual property owners. In addition to his patent work, Coburn also has experience representing clients with trademark and copyright disputes in industries such as hospitality, consumer goods, software and financial services. His experience includes both federal court litigation as well as administrative actions before the United States Patent and Trademark Office.

Coburn is a graduate of Boston College Law School (J.D., cum laude, 2011) and Hamilton College (B.A., magna cum laude, 2006).
