Mr. Su has more than 20 years of litigation experience, focusing his practice on trial and appellate matters involving antitrust, intellectual property, and technology disputes. He spent 10 years in Silicon Valley litigating patent infringement and antitrust cases for clients in the software, hardware, medical device, and biotechnology industries. Mr. Su is a registered patent attorney with the United States Patent and Trademark Office.

Additionally, Mr. Su counsels and represents clients in matters involving government agencies, drawing on his experience working with the U.S. Federal Trade Commission (FTC) for more than six years, where he served as a trial lawyer in the Bureau of Competition’s Litigation Group, which was responsible for litigating anticompetitive merger and conduct cases, as well as an attorney advisor to two sitting commissioners.

Mr. Su utilizes his experience with companies, entrepreneurs, and investors in Silicon Valley, along with his background working with enforcers, regulators, and policymakers in D.C. to provide his clients with a unique perspective into the intersection of government, business, and technology interests.

A frequent author and speaker, Mr. Su is a member of the faculty for the National Institute for Trial Advocacy. He has held numerous leadership positions with national bar associations, including the American Bar Association’s Antitrust Law Section, the National Asian Pacific Bar Association, and the Federal Circuit Bar Association. Mr. Su is a member of the bar in the District of Columbia, Virginia, and California.

Venable Represents Glass House Brands in Its Acquisition of a 5.5 Million Square Foot Southern California Greenhouse Facility

Venable LLP represented Glass House Brands Inc. (NEO: GLAS.A.U and GLAS.WT.U) (OTCQX: GLASF and GHBWF), one of the fastest-growing, vertically integrated cannabis and hemp companies in the United States, in the acquisition through a subsidiary of an approximately 5.5 million square foot greenhouse facility located in Southern California (the “SoCal Facility”) for total consideration of $93.0 million in cash payable to the owner of the SoCal Facility plus additional stock considerations payable to the original holder of the option to purchase the SoCal Facility.

The SoCal Facility is located in Ventura County, California and consists of approximately 125 acres of ultra-high-tech and efficient KUBO greenhouses, including an on-site well, water treatment facilities, and natural gas generation facilities producing its own power, heat, and CO2, and six greenhouses totaling approximately 5.5 million square feet. Phase 1 of the SoCal Facility conversion to cannabis use will include the retrofit of two greenhouses and two packhouses totaling approximately 1.7 million square feet and is expected to be completed in Q1 2022. The remaining 3.8 million square feet of greenhouses will be converted in phases to cannabis use through Q4 2024.

Planned upgrades of the SoCal Facility include installation of blackout curtains, ebb and flood floors, a higher-density gutter system, dry rooms, and processing facilities, an energy-efficient supplemental LED lighting system, an upgraded HVAC system to further optimize climate conditions, and automated nutrient delivery and irrigation systems. Upon completion of approximately $40.0 million of planned upgrades, the SoCal Facility is expected to produce approximately 1.7 million dry weight pounds of cannabis biomass per year.

South Carolina based 3D Systems Inc. has sold its On-Demand Manufacturing business to leading private equity firm, Trilantic North America, for $82 million. 3D Systems’ On-Demand Manufacturing business will be rebranded under Trilantic North America’s ownership as Quickparts, and will offer a variety of advanced and rapid manufacturing services, including additive and subtractive capabilities. The sale allows 3D Systems to focus on its strategic purpose as the leader in enabling additive manufacturing solutions from applications in growing markets that demand high-reliability products.
Rimon’s legal team led the French aspects of the sale of the ODM business from 3D Systems France to Quickparts France as part of this global transaction. The team was led by Rimon Paris Partner, Olivia Lê Horovitz, and supported by Rimon Paris attorney Nicolas Simon.
Olivia Lê Horovitz has previously advised 3D Systems Corporation on its acquisition of the same French business in 2008 from CEP and Protometal at the time owned by Ziad Abou which is now reacquiring the ODM business in partnership with Trilantic North America. Akerman Wins $110 Million Jury Verdict For Client Atturo Tire

An Illinois federal jury awarded Akerman client Atturo Tire Corp. $10 million in compensatory damages and $100 million in punitive damages on September 22. Following a 5-day trial in Chicago, the jury found Toyo Tire Corp. and Toyo U.S.A. Corp. liable for unfair competition, defamation, unjust enrichment, deceptive trade practices, and tortious interference with Atturo’s business.

The dispute dates back to 2013, when Toyo brought an International Trade Commission action for design patent infringement. Toyo did not sue Atturo in the ITC or bring any trade dress claim there. Nevertheless, Toyo began conditioning settlement of the ITC action on permanent agreements of many other companies in the tire industry to never sell, manufacture, distribute, or import Atturo’s Trail Blade M/T tire. As the jury found, Toyo also misrepresented to Atturo’s existing and prospective customers and manufacturing partners that Toyo owned and Atturo infringed a trade dress right in Toyo’s Open Country M/T tire.

The Akerman trial team was based in the firm’s Chicago office and included Intellectual Property Practice Chair Brian Bianco, Litigation partner Julia Lissner, and Intellectual Property partner Jay Schafer.

“We thank the jury for their careful attention to the case,” Bianco said. “Our client, Atturo, has fought for a long time to get here. It’s gratifying that the jurors understood that what Toyo did was wrong and has finally set things right,” Bianco added.

This is the latest success for Akerman in a long string of wins in this case in the Northern District of Illinois, including several summary judgment victories, multiple sanctions orders against Toyo, and exclusion of three Toyo expert witnesses.

Eric focuses his practice on complex litigation and intellectual property matters and has represented major technology companies and other businesses in federal false advertising and antitrust class action cases, as well as trade secret and patent issues. A significant part of Eric’s practice has focused on providing effective legal counsel to Bay Area technology firms in the Northern District of California.

Eric has obtained declaratory judgments in district courts, represented global technology and consumer brands in various trademark and patent infringement cases, and managed defenses in high-tech antitrust litigation. Prior to his legal practice, Eric served as the Associate Director of Instructional Technology at Denison University, where he worked as a Digital Millennium Copyright Act agent and enforced and revised an Acceptable Use Policy for Network Resources.

Eversheds Sutherland Taps Internal Pricing Pro for First US Chief Operating Officer

Eversheds Sutherland is pleased to announce that Dwight Floyd has been promoted to serve as the firm’s first US Chief Operating Officer (COO). Based in the Atlanta office, Mr. Floyd previously served as US Chief Pricing & Value Officer since 2019. As COO, he will oversee the following departments: HR, Conflicts & Client Information, Operations, Pricing & Value, Research & Knowledge Services, and Technology & Information Services. He will also be a key liaison to support the Global Executive Management Team in the implementation and execution of the firm’s global strategy. Mr. Floyd is assuming the role as Suzanne Sparrow, the firm’s current US Chief Administrative Officer, is retiring in October.

Northwestern Pritzker School of Law, Steptoe Announce ‘Substantial Authorities: The Tax Podcast’

(September 23, 2021, Washington, DC) — Northwestern Pritzker School of Law Tax Program and Steptoe & Johnson LLP are pleased to jointly announce the launch of “Substantial Authorities: The Tax Podcast,” a series of conversations with distinguished tax figures on matters relating to tax administration, tax controversy, and tax litigation. The video podcast is hosted by Steptoe tax partner Matt Frank.

The first interview features an in-depth conversation with Albert G. Lauber, a senior judge on the US Tax Court. Lauber was appointed to the court by former President Obama and was sworn in on January 31, 2013 for a term ending in 2028. He assumed senior status on January 1, 2020. Lauber has been recognized as one of the most productive judges on the Tax Court, and some of his more notable opinions include The Coca-Cola Company v. Commissioner (2020), Whirlpool Financial Corp. v. Commissioner (2020), and Amazon.com, Inc. v. Commissioner (2017).
